Description: A conservation easement is required in all land acquisitions, either granted from the project sponsor to BPA if the sponsor is acquiring fee title, or granted from the landowner to the project sponsor if the sponsor is acquiring just the conservation easement in which BPA retains a third party right of enforcement. For fee title acquisitions, BPA will send the sponsor a draft template easement. For conservation easements granted from the landowner, the sponsor should work with BPA to draft the easement prior to ordering an appraisal.

Description: Contact BPA to develop MOA or review MOA if one already exists for the specific requirements of the acquisition under the terms of the MOA. An MOA may not be needed if the conservation easement associated with the property includes all of the necessary terms and conditions. Contact BPA to determine if this is the case.

Description: Once the appraisal has been approved and the landowner is in agreement with purchase price, the project sponsor should get a purchase and sale agreement drafted to confirm the commitment of both parties. A copy of the draft purchase and sale agreement should be provided to BPA for review.

Description: Once an interested landowner is identified, and before activities such as appraisals or environmental land audits begin on the property, the project sponsor should notify BPA of anyone other than the landowner who lives on or uses (even temporarily) the property for any purpose. Examples of this include, but are not limited to, renters, farming leases, and grazing leases. Provide BPA with the non-landowner’s names, addresses, and telephone numbers, or other information to locate or contact these individuals.
